WASHINGTON, Ind. (WTWO/WAWV) — A Montgomery man arrested after a fatal crash late Saturday in Daviess County is awaiting trail for another operating a vehicle while intoxicated charge earlier this year.
According to the Daviess County Sheriff’s Office, Jordan Wagler was arrested for OVWI with a BAC of .20% on May 27. The legal BAC limit for driving in Indiana is .08%.
Wagler had bonded out on that charge and is awaiting trial in Daviess Superior Court.
On Saturday, Wagler was driving a Jeep traveling West on County Road 700 North just before midnight. 16-year-old Lora Graber was partially leaning outside the vehicle when it sideswiped a pole near the intersection of County Road 300 East, striking her.
Graber was pronounced dead at the scene. An autopsy completed Monday showed she died from blunt force trauma to the head.
Wagler was arrested and charged with OVWI resulting in death after an initial blood draw came back showing a BAC of .18%.
Daviess Superior Court Judge Dean Sobecki set Wagler’s bond at $250,000 cash only on the charge from the recent case.
