VIGO COUNTY, Ind. (WTWO/WAWV) — The man charged with shooting another man in the arm during a scuffle on 2nd Avenue in Terre Haute now has a trial date.

21-year-old Gaden G. Cunningham, appeared in Vigo County Superior Court 1 Thursday morning for an initial hearing.

Cunningham is charged with multiple felony charges related to the events of June 4, when a Terre Haute Police Officer reportedly witnessed Cunningham shoot a man in the arm during a fight.

Court records indicate that Cunningham’s initial charges have been modified. He now faces the following charges;

  • Aggravated battery (use when the assault poses a substantial risk of death)
    • A level 3 felony
  • Battery resulting in serious bodily injury
    • A level 5 felony
  • Battery by means of a deadly weapon
    • A level 5 felony
  • Criminal recklessness committed with a deadly weapon
    • A level 6 felony
  • Pointing a firearm at another
    • A level 6 felony

During the hearing Cunningham asked the court to assign a public defender to the case. Judge Charles D. Johnson told Cunningham he is to have no contact with the victim in the case.

Judge Johnson then set a pre-trial hearing for August 16, with the jury trial tentatively scheduled for October 10.

Following the hearing, Court records show that Cunningham has filed a motion to reduce his bond, which has been set at $75,000 with no 10% allowed.
