DAVIESS COUNTY, Ind. (WTWO/WAWV) — A man charged with OVWI in a crash that killed 16-year-old Lora Graber has been released from jail after reportedly accepting a plea deal.

Jordan Wagler, of Montgomery, appeared in Daviess County Superior Court on Wednesday for a bail review hearing. During the hearing it was learned that Wagler had preliminarily agreed to a plea deal with the prosecution.

Wagler faces two class A misdemeanor charges, the first being for operating a vehicle while intoxicated endangering a person, and the second for operating a vehicle with alcohol concentration equivalent to .15 or more.

The charges stem from the events of September 23, when police said a Jeep being driven by Wagler and carrying seven passengers sideswiped a utility pole. Investigating officers said Graber had been leaning partially outside of the vehicle and hit the pole. An autopsy would show Graber died of blunt force trauma to the head.

As part of Wednesday’s hearing, Judge Dean A. Sobecki granted work release for Wagler as he awaits his scheduled change of plea hearing on December 7. A pre-sentence investigation was also ordered by the judge to be completed ahead of the December hearing.

Terms of the plea deal were not made public by the court as the document hasn’t been officially signed and accepted at this time.
