Vincennes, IN. - According to documents, back in June of 2017 Courtney Ivers' dog, Malcom bit Johnathan Russell on the leg.
Documents say, the dog was tied to her porch rail on Ivers' property with beware of dog clearly posted.
Now in Russell's affidavit to the court it states that he ran to the dog aggressively which is when the dog bit him.
Russell did not ask for the dog to be determined dangerous but the Animal Service Director asked that the dog be deemed as such.
Ivers' then filled an appeal with the Vincennes Board of Works who agreed with the director.
And then the appeal was brought to the Knox Superior Court where the judge deemed the dog dangerous and ask the dog be euthanized as a result.
The dog was placed in the care of Vincennes Animal Shelter where it was allegedly stolen from.
Ever since the litigation Malcom has been in the care of the shelter.
WTWO contacted both the city and the attorneys involved in the case and they have made no comment.
